The Apparent Miranda Roll-Back

The Supreme Court of the United States has been quite busy rolling back precedence after precedence. One of the most controversial decisions was the Citizens United Case that has opened up the floodgates for Corporations to do what they need to do. This has resulted in the tilt towards the right. Sam Alito disagreed. But, the reality is otherwise.

Now, there is of course Berghus v. Thompson. The man in question was questioned by Police for over three hours before asking for a lawyer. I will be reading the decision to understand whether in fact the claim over the roll-back of the Miranda rights is in fact true or not. What I do see is a Court that continues to be divided and hell bent on emphasizing the so-called originalist/strict constructionist doctrine. The Roberts Court will continue to legislate from the bench, despite their claims to the contrary. This is why the Kagan nomination is so vital to maintaining the vital center for the long term sake of the country.
